Parking

A number of our members had paid for parking before the club went into administration.

We hear that some have been successful in claiming a refund from the parking company, although this has been limited to 90% of the amount paid.

Season Tickets

Several of us had paid for three year season tickets and still have one or two years remaining. We should have the option of claiming back the unused part of the season tickets, especially if this was paid for with a credit card.

The Citizens’ Advice Bureau has some advice for making a claim using Section 75 of the Consumer Credit Act if you used a credit card and paid more than £100. There is also advice for those who paid by PayPal or debit card.

You may find it helpful to send this letter from the administrators along with your claim.

One member’s experience

Based on personal experience with Tesco Credit Card. We identified a process that they called Chargeback on a Transaction and which allowed us to complete an online claim form. During this submission, we identified:

  • The total cost of our multi-season ticket package, less the amount in respect of tickets that we had received = balance outstanding for items not received

In our case, we bought 2 x tickets for 3 seasons before the 22/23 season and received that one season, so were owed 2/3 of our total payment for the 23/24 and 24/25 seasons.

Having submitted the online form, we received an email from Tesco Credit Card requesting evidence to support our claim, to which we submitted:

  • Resolve Administrators Letter to Creditors
  • Open Letter from Mick Crossan
  • Our April 2022 Credit Card Statement showing the payment to London Irish for the Season Tickets
  • Email Receipt of Payment from London Irish, which helpfully explained what the payment was in respect of

We submitted these documents towards the end of June and received a Purchase Adjustment (credit) to our credit card account in the July statement, for the full amount claimed.

An unsuccessful claim

One of our members has shared that they were experiencing difficulties with HSBC Credit Card who suggested that, because the payment was made over 120 days before, they would not pay.

If this was paid by credit card then Section 75 should apply. The 120 day rule is usually applied to Chargeback – a scheme offered by Visa, Mastercard and American Express, but unlike Section 75 it is not legal protection.
